inQuire Media Group Terms of Use

‘inQuire Media Group’ consists of the ‘inQuire’ newspaper and ‘inQuire Live’. Both mediums are produced exclusively by University of Kent students and both projects are funded and supported by Kent Student Union.

However the opinions expressed by ‘inQuire Media Group’ are not that of Kent Union or University of Kent.

From the first use of either medium, you (the user) are deemed to have accepted the conditions below. If you do not agree to the following terms please do not use or contribute to ‘inQuire’ or ‘inQuire Live’

1. Use of material

1.1 For the purposes of this agreement, “material” means material including, without limitation, text, video, graphics and sound material, published on ‘inQuirelive’, or whether copyright of ‘inQuire’.

1.2 You may download and print extracts from the material and make copies of these for your own personal and non-commercial use only. You are not allowed to download or print the material, or extracts from it, in a regular manner so as to create a database in electronic or paper form comprising all or part of the material appearing in ‘inQuire Live’ or ‘inQuire’.

1.3 ‘inQuire Media Group’ may be prepared to allow you to distribute or reproduce other parts of ‘inQuire’ or ‘inQuire Live’ in certain circumstances. Please email the Editor in Chief at inQuire@kent.ac.uk if you wish to apply for permission to do so.

2.0 Disclaimer of liability

2.1 To the extent permitted at law, inQuire Media Group do not accept any responsibility for any statement in the material. You must not rely on any statement ‘inQuire’ and ‘inQuire Live’ have published on ‘inQuire’ or ‘inQuirelive’ without first taking professional advice. Nothing in the material is provided for any specific purpose or at the request of any particular person.

2.2 For the avoidance of confusion, ‘inQuire’ and ‘inQuire lLive’ will not be liable for any loss caused as a result of your doing, or not doing, anything as a result of viewing, reading or listening to the material or any part of it (except for death or personal injury attributable to our negligence and to the extent permitted at law).

2.3 You can access other sites via links from inQuirelive.co.uk. These sites are not under our control and ‘inQuire Live’ are not responsible in any way for any of their contents.

2.4 ‘inQuire Media Group’ give no warranties of any kind concerning ‘inQuire Live’ or the material. In particular, ‘inQuire Media Group’ do not warrant that ‘inQuire Live’ or any of its contents is virus free. You must take their own precautions in this respect as ‘inQuire Media Group’ accept no responsibility for any infection by virus or other contamination or by anything which has destructive properties.

3.0 Third party material

3.5 You will see advertising material by third parties in ‘inQuirelive’ and ‘inQuire’. Individual advertisers are solely responsible for the content of advertising material which they submit to us, including ensuring that it complies with relevant legislation. ‘inQuire Media Group’ accept no responsibility for the content of advertising material, including, without limitation, any error, omission or inaccuracy therein.

4.0 Submitting graphical material and photography for publication

4.1 When submitting a photograph or other graphic material you hereby agree that you have taken the photograph(s) you have sent to us or you have permission from or are authorised by the owner of the photograph(s) to send it (them) to us, and you are granting us a non-exclusive, royalty-free licence to publish or otherwise use the photograph(s) in any way and at any time on both ‘inQuirelive’ and ‘inQuire.’

4.2 If you submit a photograph or other graphic material for either ‘inQuirelive’ or ‘inQuire’ you agree that it can be used interchangeably between both.

4.3 Selected photographs and graphical material will be published at the discretion of the editor and you will not be paid, even if your photograph(s) is (are) published.

4.4 Your name will be published alongside your photograph(s) or graphic, but ‘inQuire Media Group’ may edit or delete any comments which you submit along with your photograph(s) or graphic.

4.5 ‘inQuire Media Group’ may cut, edit, crop or arrange your photograph(s) or graphic as ‘inQuire Media Group’ think fit, and ‘inQuire Media Group’ may remove your photograph(s) or graphics at any time.

IMPORTANT: You or the owner of the photograph(s) still own the copyright in the photograph(s) sent to us and are free to republish the photograph(s) wherever you or the owner wish and in whatever medium you or the owner want.

5.0 Submitting text for publication

5.1 Users of our site may submit material for publication, including our article comment and official blogs. ‘inQuire Media Group’ accept no liability in respect of any material submitted by users and published by ‘inQuire Media Group’ are not responsible for its content and accuracy.

5.2 If you want to submit material to us for publication on, you may do so on the following terms and conditions:

5.2.1 Publication of any material you submit to us will be at our sole discretion. ‘inQuire Media Group’ reserve the right to make additions or deletions to the text or graphics prior to publication, or to refuse publication

5.2.2 You grant us a non-exclusive, perpetual, royalty-free, worldwide licence to republish any material you submit to us in any format, including without limitation print and electronic format

5.2.3 You warrant to us that any material you submit to us is your own original work and that you own the copyright and any other relevant rights

5.2.4 You warrant that the material you submit is not obscene, offensive, defamatory of any person or otherwise illegal

5.2.5 You agree not to post material which is deliberately intended to upset other users

5.2.6 You acknowledge that any breach of these warranties may cause us damage or loss and you agree to indemnify us in full and permanently against any third party liabilities, claims, costs, loss or damage ‘inQuire Media Group’ incur as a result of publishing material you submit to us, including consequential losses.

6.0 Complaints Procedure

6.1 If you feel that any part of material the published in inQuire or inQuirelive is inaccurate or convenes the Press Complaints Commissions Editors Code of Practice, please follow these guidelines:

6.1.1 Contact the Editor in Chief who will look into the complaint and he or she aims to explain the action that will be taken as a result of your complaint within 10 days.

6.1.2 If the inQuire Media Group have made a mistake, then we will either remove the material from ‘inQuirelive’ immediately or publish a public apology in the following issue of the newspaper ‘inQuire’.

6.1.3 If you are not satisfied with this response please contact the Media Department at Kent Union who will look into the complaint. They will address the issue as an independent body to inQuire Media Group. Please contact:

6.2 If you have a complaint against an individual working on behalf on ‘inQuire Media Group’ then please contact the Media Department at Kent Union (details above) and they will access it in relation to the editorial and volunteering procedures.

6.3 ‘inQuire Media Group’ takes all complaints seriously and aims to treat every complaint with respect and equal consideration.

7.0 Right of Reply

7.1 With all articles published by inQuire Media Group we offer a right of reply. This reply should be relevant to the article and in response to its content. It should not attack the individual writer or express any threatening behaviour towards the individual.

7.2 inQuire Media Group reserves the right to edit material when deemed inappropriate or due to space restrictions but where applicable will aim to consult the individual on those changes.

8.0 Variations

8.1 These terms may be varied from time to time. Please ensure that you review these terms and conditions regularly as you will be deemed to have accepted a variation if you continue to use the site after it has been posted.
